Abstract In Ukraine, a prosecutor via the function of representation of state’s interests in court aims at protecting rights and common interests of the society and the state. This function of representation is imposed on prosecutors by legislation in the Commonwealth of Independent States and the majority of the European Union member states. However, in most of the abovementioned states, the scope of prosecutor’s rights differs from those of other parties to the court proceeding.
The purpose of the article – to outline the powers of a prosecutor in representing state’s interests in court through the analysis of the current legislation and researches in the area; to suggest relevant amendments and supplements to the legislation.
Pursuant to the article 1311 of the Constitution of Ukraine a prosecutor represents the state’s interests in court in exceptional cases and in manner determined by law. It is stated in part 1 of the article 23 of the Law of Ukraine “On the Prosecutor’s Office” that representation of citizen’s or state’s interests in court is a set of procedural and other activities aiming at protecting citizen’s and state’s interests in cases and in manner determined by law. A prosecutor represents state’s interests exclusively after the court has confirmed the grounds for representation and a prosecutor has provided evidences that the competent authority fails to protect the state, or that it is impossible due to the absence of such authority. However, it is obvious from the experience and European legislation that the demand set forth in the Article 23 of the Law of Ukraine “On the Prosecutor’s Office” to represent the state’s interests only after the court has confirmed the grounds for representation is not relevant.
The study has shown that prosecutors in the Commonwealth of Independent States and in some European Union states are entrusted with powers to represent citizen’s and states’ interests in court. To ensure these powers the article 1311 of the Constitution of Ukraine and part 1 of the article 23 of the Law of Ukraine “On the Prosecutor’s Office” should be supplemented with the grounds for the representation.
